The power to declare war falls under both the Articles of Confederation and the U.S. Constitution. Initially, the Articles of Confederation granted the power to declare war to the Congress. However, this authority was later inherited by the U.S. Constitution, which also granted the power to declare war to Congress in Article I, Section 8.
