The establishment of the Supreme Court is under the United States Constitution and not the Articles of Confederation. The Articles of Confederation, the first governing document of the United States, did not include provisions for the establishment of a federal judiciary system or a Supreme Court. The authority and structure of the Supreme Court are specified in Article III of the United States Constitution.
