Monty is the owner of a laundromat. Due to loadshedding and the “cost of living”

crisis his business is experiencing financial problems. His friend, Kabelo, buys the
washing machines in the laundromat from Monty. Kabelo and Monty agree that Monty
can still use the washing machines to operate the laundromat and that Kabelo will transfer
ownership of the machines to Monty once he (Monty) has paid the full purchase price.
After six months, before Monty paid the purchase price to Kabelo, Monty is declared
insolvent. Mr Jones, the executor of Monty's insolvent estate wants to sell the washing
machines and use the proceeds to pay Monty's creditors. However, Kabelo informs Mr
Jones that he has bought the washing machines from Monty and that they now belong to
him. Fully discuss the legal relationship between Monty and Kabelo as well as the
ownership of the washing machines and Mr Jones’s claim to them

In this scenario, the legal relationship between Monty and Kabelo is that of a seller and buyer. Monty is the owner of the laundromat and Kabelo is purchasing the washing machines from him. They have agreed that Monty can continue to use the machines until he has paid the full purchase price.

However, it is important to note that ownership of the washing machines has not transferred from Kabelo to Monty yet because Monty has not paid the full purchase price. Until the purchase price is fully paid, Kabelo remains the legal owner of the machines.

When Monty is declared insolvent, Mr. Jones, as the executor of Monty's insolvent estate, has the authority and duty to sell Monty's assets in order to pay off Monty's creditors. However, Mr. Jones can only sell assets that belong to Monty, and since Monty has not yet paid the full purchase price for the washing machines, they still legally belong to Kabelo.

Therefore, Mr. Jones does not have a claim to the washing machines and cannot sell them to pay off Monty's creditors. Kabelo has the right to retain ownership of the machines. However, Monty's insolvent estate may still be liable for any outstanding amount owed to Kabelo for the purchase of the machines.

It is advisable for Mr. Jones to consult with a legal professional to determine the appropriate course of action regarding Monty's assets and the payment of creditors in light of the legal relationship and ownership of the washing machines between Monty and Kabelo.
