  1. I agree with your answers to one and two. I'm not sure about the third. If the lawsuit is based on state law, the state courts would have jurisdiction no matter who the defendant is. I think it depends on the nature of the lawsuit as to which court system has jurisdiction, but I have no citations for you. Double check your text materials. What, exactly, is written there?

  2. I do believe that a foreign national living in the U.S. is subject to all laws, be they local, state, or federal laws. The appropriate court must treat them the same as anyone else.
