THE LAW FURTHER PROVIDES THAT ANY EMPLOYER WHO ALLOWS EITHER AN EMPLOYER OR A CLIENT/CUSTOMER TO SMOKE BE SUBJECT TO A COURT ORDER REQUIRING THE EMPLOYER TO ENFORCE THE LAW. I don't know which state you mean. This might make a difference. Are you talking about a misdemeanor?

Since this is not my area of expertise, I searched Google under the key words "Smoking Statute classification" to get these possible sources:

    http://falkandowens.com/a-listing-of-the-kansas-statutes-dealing-with-criminal-offenses.pdf
    (Broken Link Removed)
    http://www.wmitchell.edu/tobaccolaw/resources/Sbarra.pdf

In the future, you can find the information you desire more quickly, if you use appropriate key words to do your own search.

I hope this helps. Thanks for asking.
