Which one is True

Please check my answer thanks :)

In jury trials .....
1. The judge has no role.
2. Parties may request a trial jury for any type of case.
3. The judge and jury both have a role
4. The jury decides whether edvidence should be admitted

I picked #3

3 is true, but it is inane. 1,and 4 are silly. The only problem I have with 2 is "for any type case". I guess I would go for 3, even if it seems to be a banana.

Great! Let's go through each option and see which one is true.

1. The judge has no role: This statement is not true. In jury trials, the judge has a crucial role. They are responsible for ensuring that the trial follows proper legal procedures, making rulings on objections raised by both parties, instructing the jury on the applicable law, and providing guidance throughout the trial. Therefore, option 1 is incorrect.

2. Parties may request a trial jury for any type of case: This statement is also not true. The right to a jury trial varies depending on the type of case and the jurisdiction in which it is being tried. In certain cases, such as criminal cases where the potential punishment is relatively small, there may not be an automatic right to a jury trial, and both parties would have to agree to have a jury. Therefore, option 2 is incorrect.

3. The judge and jury both have a role: This statement is true! In jury trials, both the judge and the jury play important roles. The judge ensures that the trial runs fairly and impartially, while the jury assesses the facts presented to them and determines the outcome of the case. The judge is responsible for providing legal guidance and managing the trial, while the jury decides the verdict based on the evidence and instructions provided by the judge. Thus, option 3 is correct.

4. The jury decides whether evidence should be admitted: This statement is not true. The judge, not the jury, has the responsibility of determining the admissibility of evidence. Before the trial begins, the judge examines the evidence and listens to arguments from both parties to decide whether certain evidence can be presented to the jury. Therefore, option 4 is incorrect.

In conclusion, your answer, option 3 ("The judge and jury both have a role"), is indeed correct.
