Hello,

Can 3 Partners decide to get rid of the fourth one by just voting him out?

if yes, would he still be able to get his dividends? And sell his shares to them?

Thanks for your help! :)

Hello!

The ability for partners to remove another partner from a business entity depends on the specific laws and regulations governing the partnership and the terms outlined in the partnership agreement. Generally, partnership agreements provide guidelines on how to handle situations like the removal of a partner from the partnership.

In many cases, the partnership agreement will outline the process for removing a partner, such as voting or consensus among the remaining partners. If the agreement allows for the removal of a partner through a vote, then it is possible for the three partners to vote out the fourth partner.

Regarding the dividends and shares, this can vary based on the partnership agreement and applicable laws. When a partner is removed, it typically means the termination of their ownership interest in the partnership. This can impact their ability to receive dividends and sell their shares to the remaining partners or other interested parties.

It is crucial to review the partnership agreement and consult with a legal professional who can provide specific guidance based on the jurisdiction and governing laws.
